Minesafe Resources: Terms & Conditions

1. Payment Terms

Payment Period: Payment is strictly due thirty (30) days from the date of invoice unless otherwise agreed in writing.  

Discrepancies: Clients must notify Minesafe Resources of any invoice discrepancies within seven (7) days of the invoice date.  

Late Payments: Minesafe Resources reserves the right to charge interest on overdue invoices at a rate of 2% per month. The client may also be liable for all legal and recovery costs.  

2. Pricing and Quotations

Adjustments: Minesafe Resources reserves the right to adjust quoted prices due to changes, labour rates.  

Validity: All quotations are valid for thirty (30) days from the date of issue unless specified otherwise.  

3. Service Delivery & Client Responsibilities

Site Access: The client must ensure the site is safe, adequately prepared, and accessible for scheduled services in compliance with all health and safety regulations.  

Delays: If delays occur due to client site inaccessibility or lack of preparation, Minesafe Resources reserves the right to charge standby fees at prevailing hourly rates.  

Cancellations: A minimum of 48 hours’ written notice is required for cancellations. Cancellations made with less than 48 hours’ notice may incur charges for the first scheduled shift of each technician.  

4. Liability and Warranty

General Limitation: To the extent permitted by law, liability is limited to refund of services at the discretion of Minesafe Resources.  

Exclusions: Minesafe Resources is not liable for indirect, special, or consequential damages, including loss of profits or business interruption.  

Force Majeure: Minesafe Resources shall not be liable for failures or delays caused by circumstances beyond its reasonable control, such as natural disasters or government acts.  

5. Confidentiality and Privacy

Privacy: All personal and sensitive information is managed in accordance with the Privacy Act 1988 (Cth).  

Information Security: Data is stored on secure, password-protected systems and will only be disclosed to third parties as required by law or to prevent serious threats to life and safety.  

6. Governing Law

These Terms are governed by the laws of Western Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
